Wisconsin’s deceased-tenant rule, the tenant’s belongings, neighboring units and who pays.

Quick answerWhen a tenant dies, call 911 and wait for the medical examiner’s release. Wisconsin statute 704.165 sets when the tenancy ends, and separate rules cover property left behind. Cleanup is usually covered by the landlord’s property insurance. MadTown documents everything for your file. Reviewed by Kevin, who leads our Madison team · Updated November 2026.
First steps
The first day
If you find a tenant who has died, call 911 and don’t go further into the unit. Police and the medical examiner will handle the scene and tell you when the unit is released.
Secure the unit afterward, and keep a record of who has had access.

The lease
When the tenancy ends
Under Wisconsin statute 704.165, when a tenant dies, the tenancy generally ends 60 days after the landlord learns of the death, or at the end of the lease term, whichever comes first. Another adult tenant on the lease generally stays responsible under it.
Read the statute, or talk to your attorney, before making decisions about rent or the lease.
Belongings
The tenant's belongings
The tenant’s property belongs to their estate. Wisconsin has rules for how and when a landlord can handle property left behind. Don’t throw things away in a hurry.
We set belongings aside, can list them for the family or the estate and clean what can be cleaned.
Neighbors
Neighboring units and shared air
Fluids can reach the unit below and odor travels through shared walls, ductwork and hallways. We check the units on each side and below and treat shared spaces when needed.
Tell other tenants only what they need to know. We keep our work quiet.
Paying
Who pays for cleanup
Usually the landlord’s property insurance covers the unit. We document the job with photos and a written scope and bill the insurer directly.
